We operate under Tunisian law. For consumers in the EEA/UK/Switzerland, we also apply the information and transparency principles of GDPR.

These terms govern access to the Site, account creation, use of services, and the sale of products listed by Barbarij and/or third-party artisan sellers (the "Sellers").

Customer: any person who creates an account and/or makes a purchase.

Seller: artisan or entity that offers Products via the Marketplace.

Product: any item offered on the Site.

Account: personal space allowing purchase, tracking, publishing (depending on role).

Access to and use of the Site implies full acceptance of these Terms and Conditions. If you do not accept, do not use the Site.

The Customer/Seller agrees to provide accurate information and keep it updated.

Credentials are personal. You are responsible for their confidentiality.

Barbarij may suspend or close any Account in case of fraudulent, illegal, or non-compliant use.

Barbarij hosts the Marketplace, provides the technical interface, facilitates connections, offers certain customer services, and fights fraud.

Unless otherwise stated, each Seller is solely responsible for their Products, descriptions, prices, inventory, legal compliance, labeling, warranties, and after-sales service.

Product listings indicate the relevant Seller.

Photos are illustrative. Essential characteristics are listed on the product page.

Prices are indicated in TND including all applicable taxes (unless otherwise stated).

Offers are valid while visible and subject to stock availability.

Steps: (i) product selection, (ii) summary, (iii) delivery details, (iv) payment. Order confirmation is binding. Barbarij/Seller reserves the right to refuse or cancel (suspected fraud, obvious error, unavailability).

Payment is processed via a secure third-party payment provider. Barbarij does not store card data.

Payment is due immediately. In case of payment failure, the order is cancelled.

Modes and times offered at checkout (carrier, zone, cost).

Risks are transferred upon delivery to the Customer. Check the package upon receipt and make any necessary reservations with the carrier and Seller within the prescribed timeframes.

Barbarij commercial policy: you may request a return within 7 calendar days from receipt, Products unused and in original packaging (excluding perishable, personalized, sealed hygiene products that have been opened, etc.).

This policy applies without prejudice to mandatory rights provided by Tunisian law or, where applicable, consumer protection law of your country of residence.

Procedure: request via Account or contact.barbarij@gmail.com → validation → return → inspection → refund of Products (excluding initial delivery and return costs, except for defect/error attributable to Seller).

Sellers guarantee legal compliance of Products.

In case of defect, contact the Seller first (via your order). Barbarij may assist with mediation. Possible solutions: repair/replacement/refund as applicable.

Reviews must be honest, based on actual purchase experience, and not contain illegal content (defamation, infringement of rights, personal data).

Barbarij reserves the right to moderate/delete any non-compliant content.

Provide accurate descriptions, comply with labeling, hygiene and safety rules, and applicable regulations (particularly food, cosmetics, handicrafts).

Keep inventory and prices updated, deliver within announced timeframes, provide after-sales service.

Comply with Marketplace policies (fraud, counterfeiting, product recalls).

The Site, its structure, texts, logos, photos, trademarks and databases are protected.

Any unauthorized reproduction, representation or extraction is prohibited.

The processing of your data is described in our Privacy Policy and Cookie Policy (Google Analytics, Hotjar for audience/UX measurement, with consent where applicable). DPO Contact: contact.barbarij@gmail.com.

Specifically prohibited: (i) use of the Site for illegal, harmful, fraudulent purposes; (ii) infringement of third-party rights; (iii) intrusion, unauthorized mass scraping, circumvention of security measures; (iv) posting false reviews; (v) counterfeiting or unauthorized resale.

The Site is provided "as is". Barbarij implements reasonable measures for availability and security.

Barbarij is not responsible for indirect damages or temporary unavailability.

For sales by third-party Sellers, primary responsibility lies with the relevant Seller.

No party is responsible for a breach due to a force majeure event (as defined by applicable law) making performance of the obligation impossible.

Linked third-party sites have their own terms. Barbarij is not responsible for their content or practices.

These terms apply for the entire duration of use of the Site.

Barbarij may modify the Terms at any time. The enforceable version is the one published with its update date.

Each party may terminate the relationship by closing their Account (subject to pending orders and legal obligations).

Tunisian law.

Jurisdiction: territorially competent courts (Nabeul/Tunis according to procedural rules), subject to any mandatory consumer protection jurisdiction.
